Purpose and scope of application

By booking the offer, the participant recognizes and accepts these general terms and conditions as an integral part of the contractual relationship between FitCube and the participant.

Dates

The type and scope of the service units are agreed with the participant and/or are based on the details in the respective booking description. Training units are only provided against prior booking via the billing system. The booking is binding. When booking a service area, the customer is not entitled to services from a specific specialist.

Power units

The service units consist of training, counseling or therapy units.

Payment method

The service units and subscriptions are paid in advance. The offers can be paid against invoice, payable net within 20 days. The participant shall be in default without further reminder after expiry of the payment deadline.

Bookings

Prevention & Cancellation Appointments must be kept by the participant. If the participant is unable to attend, the booking must be canceled via the booking system by email or by calling the studio at least 24 hours before the start of a service unit.

Postponement & refund

Appointments can be rescheduled if canceled in good time. The participant must book a new training session via the MindBody system. There is no entitlement to a refund of the price.

Failure of the specialist

If the service unit cannot be performed by the booked specialist, the participant agrees to take advantage of it with another specialist available at the booked time. If no specialist can be provided by FitCube at the booked time, the booked service unit will not be carried out and the participant will be credited. FitCube will endeavor to notify the customer immediately in the event of a cancellation and will inform the customer using the contact details known to it. FitCube will not compensate any damages incurred by the participant as a result of such cancellations and/or schedule changes.

Subscriptions:

The 25-personal training subscription runs for 12 months and includes 25 personal training sessions of 55 minutes each. The 10-personal training subscription has a term of 6 months and includes 10 personal training sessions of 55 minutes each. The 10-person physiotherapy self-payer subscription runs for 6 months and includes 10 therapy sessions of 25 minutes each. Subscribers can only make up appointments not attended within the period of the current subscription. If the participant does not cancel or does not cancel in time (see dates above), the training session will be charged. If the subscription is not used within the specified period or a training session is not attended or booked, there is NO entitlement to a refund of the price. In the event of prolonged illness or accident, the unused time due to illness or accident can be credited or refunded at the discretion of FitCube upon presentation of a medical certificate.

Operating hours

The Fitness Academy is open during operating hours with the exception of event days. Information about operating hours or special opening times will be announced in good time on the homepage and in the studio.

Insurance / Exclusion of liability

Insurance is the responsibility of the participants. The training sessions are aimed at adults, children with parental consent and healthy participants. Participants are obliged to inform FitCube of any existing injuries, physical complaints or limitations. FitCube accepts no liability for accidents and damage of any kind suffered by the participant when using the services.

Medical history (health questionnaire)

Completion of the anamnesis (health questionnaire) is obligatory and is completed at the latest at the 1st training session together with a specialist.

Participants are obliged to answer the questions truthfully and to inform FitCube if there is a change in their health during the term of the contract. In the event of any health risks, FitCube may require the participant to undergo a medical examination.

House rules

The house rules are recognized by the participant in their current version.

Data protection regulations

The data and personal details collected during the registration process are used exclusively for the purpose of complete order fulfillment.

Amendments to these General Terms and Conditions

FitCube reserves the right to amend these General Terms and Conditions unilaterally at any time. The current version of the General Terms and Conditions will always be published on the website.

Place of jurisdiction and applicable law

All legal relationships between the participant and FitCube are subject exclusively to Swiss law. The exclusive place of jurisdiction for all disputes arising from or in connection with these General Terms and Conditions is the registered office of FitCube.
